Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Client,” or “you”) and 4UProfit Business LLC (“4UProfit,” “we,” “us,” or “our”), a limited liability company organized under the laws of the State of Florida, United States, which operates the 4UProfit platform and related services.
These Terms govern your access to and use of the 4UProfit website, client dashboard, technology infrastructure, automated execution and trade-replication services, demo environments, memberships, software, tools, reports, support services, and any related features made available by 4UProfit (collectively, the “Service”).
Please read these Terms carefully before accessing or using the Service.
1. ACCEPTANCE OF TERMS
By creating an account, purchasing or activating a membership, connecting a brokerage account, selecting an acceptance checkbox, using the Service, or otherwise indicating your agreement electronically, you confirm that:
- you have read and understood these Terms;
- you agree to be legally bound by them;
- you have the legal capacity to enter into this agreement; and
- you agree to the policies incorporated by reference.
These Terms incorporate, where applicable, the following documents:
- Privacy Policy;
- Cookie Policy;
- Risk Disclosure;
- Performance Disclosure;
- Membership and Billing Policy;
- Broker Independence and Conflict of Interest Policy;
- End-User License Agreement; and
- any additional disclosures presented during registration, account connection, membership activation, or checkout.
If you do not agree with these Terms, you must not access, connect to, purchase, or use the Service.
2. CHANGES TO THESE TERMS
4UProfit may update these Terms to reflect changes in the Service, technology, business model, applicable law, risk controls, broker compatibility, billing practices, or operational requirements.
The updated version will display a revised “Last Updated” date.
Where reasonably practical, 4UProfit will provide notice of material changes that affect active users. Continued use of the Service after the effective date of updated Terms constitutes acceptance of those changes, except where applicable law requires additional consent.
3. NATURE OF THE SERVICE
4UProfit is a financial technology platform that connects compatible client-owned brokerage accounts to automated execution and trade-replication technology.
The Service may include:
- transmission of approved strategy activity;
- automated order execution through compatible connections;
- account monitoring;
- operating and risk controls;
- performance reporting;
- account-connection management;
- membership management;
- alerts and activity information;
- demo environments; and
- technical and operational support.
4UProfit does not accept deposits from clients and does not custody client capital.
Client funds remain in the client-owned brokerage account maintained with an independent third-party broker.
4UProfit is not:
- a broker;
- a bank;
- an exchange;
- a custodian;
- an investment fund;
- a pooled investment vehicle; or
- a provider of legal, tax, or accounting advice.
The Service provides technology and operating infrastructure. It does not guarantee any particular financial result.
4. AUTOMATED EXECUTION AND SUPERVISION
The 4UProfit operating model combines automated execution with supervised strategy operation.
Approved strategy activity may be transmitted automatically to connected brokerage accounts according to:
- the selected operating level;
- reference capital;
- available margin;
- account compatibility;
- connection status;
- strategy parameters;
- risk settings;
- instrument availability; and
- broker execution conditions.
Automation manages order transmission and execution. Operational supervision does not eliminate market risk, execution risk, technology risk, or the possibility of loss.
The strategy may remain inactive when market or operating conditions do not satisfy its criteria.
4UProfit does not guarantee that the strategy will trade every day, every week, or during every billing period.
5. PRIMARY AND SECONDARY OPERATING ENVIRONMENTS
The primary operating environment is Futures trading through compatible NinjaTrader accounts.
Forex and CFD execution may be available as a secondary alternative through supported brokers, depending on:
- the client’s jurisdiction;
- broker eligibility;
- account type;
- regulatory restrictions;
- platform compatibility; and
- current 4UProfit availability.
Not every platform, broker, instrument, or service is available in every country, state, or territory.
6. FUTURES OPERATING SCHEDULE
The Futures strategy operates on an intraday basis using Eastern Time (“ET”).
Futures positions are designed and configured to be closed within the applicable trading session, generally no later than 5:00 p.m. ET.
4UProfit does not intentionally maintain Futures positions overnight.
Extraordinary circumstances outside 4UProfit’s reasonable control—including broker outages, exchange interruptions, rejected orders, market halts, connectivity failures, extreme price movement, or platform malfunction—may affect order execution or closing behavior.
7. FOREX AND CFD POSITIONS
Forex and CFD operations are generally managed on an intraday basis.
However, market conditions, liquidity, broker execution, connection interruptions, or strategy requirements may occasionally result in a Forex or CFD position remaining open beyond the same trading day.
Clients remain responsible for monitoring their brokerage accounts, available margin, and open positions.
8. REFERENCE CAPITAL
Each membership level is associated with a recommended reference-capital amount.
Reference capital is used to determine:
- the intended operating level;
- position sizing;
- risk parameters;
- monetary exposure;
- applicable membership price; and
- account eligibility.
Reference capital is not a guarantee, insured amount, protected balance, or promise that the account will remain at that value.
A client may maintain a balance above the applicable reference capital. However, funds maintained above one operating level but below the requirements of the next level may not increase strategy sizing or generate proportionally greater operating capacity.
A client attempting to use a higher membership level without sufficient capital may not qualify for execution because the required margin and risk parameters cannot be maintained.
9. RISK PER OPERATION
The strategy is designed to use a planned risk that generally ranges between approximately 1% and 2% of the applicable reference capital for an individual operation, depending on the current strategy configuration, instrument, and market conditions.
This planned risk range:
- applies to the operating parameters assigned to an individual operation;
- is not a guarantee of the final realized loss;
- is not a maximum account drawdown guarantee;
- does not prevent cumulative losses across multiple operations or periods; and
- may be exceeded in extraordinary circumstances beyond reasonable control.
Actual losses may differ because of:
- slippage;
- price gaps;
- market halts;
- reduced liquidity;
- rejected orders;
- broker execution;
- exchange interruptions;
- latency;
- technology failure;
- margin liquidation; or
- other market and operational conditions.
10. ELIGIBILITY
To use the Service, you must:
- be at least eighteen years old;
- have the legal capacity to enter into a binding agreement;
- provide accurate, complete, and current information;
- maintain a compatible brokerage account;
- satisfy the broker’s eligibility, jurisdictional, margin, and account requirements;
- use the Service only for lawful purposes;
- not be prohibited from receiving the Service under applicable law; and
- comply with these Terms and the broker’s agreements.
If you use the Service on behalf of a company or another legal entity, you represent that you have authority to bind that entity.
4UProfit may refuse, restrict, suspend, or terminate access where eligibility, security, legal, regulatory, broker, or technical requirements are not satisfied.
11. JURISDICTIONAL AVAILABILITY
Availability is subject to:
- applicable laws;
- broker-supported jurisdictions;
- instrument restrictions;
- regulatory requirements;
- account eligibility; and
- 4UProfit’s current technical and operational availability.
Clients are responsible for determining whether the Service, broker, account type, and instruments are permitted in their jurisdiction.
4UProfit may restrict or discontinue availability in any jurisdiction where continued service may be unlawful, technically incompatible, or operationally impractical.
12. ACCOUNT REGISTRATION
You must create an account to access certain portions of the Service.
You agree to:
- provide truthful and current information;
- maintain only authorized accounts;
- promptly update inaccurate information;
- protect your credentials;
- use secure devices and connections;
- notify 4UProfit of unauthorized access; and
- remain responsible for activity conducted through your account.
4UProfit may request additional verification where reasonably required for security, fraud prevention, payment processing, legal compliance, or account eligibility.
13. ACCOUNT SECURITY
You are responsible for maintaining the confidentiality and security of:
- your 4UProfit credentials;
- your email account;
- your broker credentials;
- connected devices;
- authentication methods; and
- any access information associated with the Service.
You must immediately notify 4UProfit at support@4uprofit.com if you suspect unauthorized access.
4UProfit is not responsible for losses resulting from compromised credentials, insecure devices, unauthorized sharing, or failure to protect account access, except where responsibility cannot legally be excluded.
14. CLIENT-OWNED BROKERAGE ACCOUNT
The client opens, owns, and controls the brokerage account.
The broker:
- holds client funds;
- processes deposits;
- processes withdrawals;
- establishes margin requirements;
- executes orders;
- maintains account records; and
- applies its own terms and policies.
4UProfit does not:
- hold client funds;
- receive client deposits;
- approve withdrawals;
- block withdrawals;
- transfer client funds to itself;
- guarantee broker solvency; or
- control the broker’s processing times.
15. WITHDRAWALS
Clients request withdrawals directly from their broker.
4UProfit does not prevent or approve withdrawals.
Withdrawal availability and timing may depend on:
- available cash;
- open positions;
- margin requirements;
- pending settlements;
- broker procedures;
- identity verification;
- applicable laws; and
- processing times.
Statements such as “withdraw at any time” refer to the client’s control over the brokerage relationship. They do not guarantee immediate availability of every dollar while margin is in use, positions remain open, or broker restrictions apply.
16. BROKER INDEPENDENCE
4UProfit does not receive:
- referral commissions;
- CPA payments;
- revenue-sharing payments;
- introducing-broker compensation;
- paid broker-ranking fees;
- sponsored-listing compensation; or
- financial incentives to recommend one broker over another.
Broker inclusion is based on criteria such as:
- regulatory standing;
- reputation;
- operating history;
- execution quality;
- platform compatibility;
- API or connection availability;
- pricing transparency;
- funding and withdrawal reliability; and
- jurisdictional availability.
The order in which brokers appear on the website does not constitute a paid ranking.
Any future material commercial or technology relationship with a broker will be disclosed where appropriate.
17. THIRD-PARTY BROKERS AND PLATFORMS
Brokers, NinjaTrader, MetaTrader, exchanges, payment processors, data providers, and other third-party services are independent from 4UProfit.
Their services are governed by separate agreements.
4UProfit does not control and is not responsible for:
- broker solvency;
- broker pricing;
- spreads;
- commissions;
- order rejection;
- margin requirements;
- liquidation;
- data accuracy;
- platform availability;
- withdrawal processing;
- third-party security incidents; or
- changes made by third-party providers.
Links to third-party websites are provided for convenience and do not create an endorsement, agency, partnership, or fiduciary relationship.
18. MEMBERSHIP PLANS
Access to live services may require an active paid membership.
Each membership may include:
- a reference-capital level;
- a recurring price;
- platform access;
- automated execution access;
- monitoring;
- reporting; and
- applicable support.
Current membership prices, reference-capital levels, and features are displayed on the Memberships page or during checkout.
Higher membership levels reflect greater operating-capital capacity. They do not imply higher percentage returns or guaranteed performance.
19. BILLING CYCLE
Memberships are billed in recurring thirty-day cycles beginning on the activation date.
Unless the client disables automatic renewal, the membership will renew automatically every thirty days using the authorized payment method.
Before activation, the client must be shown the applicable:
- membership price;
- billing interval;
- automatic-renewal status;
- cancellation method; and
- material membership terms.
Taxes or payment-processing charges may apply where required.
20. AUTOMATIC AND MANUAL RENEWAL
Automatic renewal is enabled as the standard continuity option.
A client may disable automatic renewal and use manual renewal where that option is available.
No penalty applies solely because the client selects manual renewal.
However, if the membership expires or becomes inactive:
- the account will not receive new strategy activity;
- future orders will not be transmitted until access is restored;
- operations missed during the inactive period will not be recreated automatically; and
- the client’s performance may differ from the source strategy or historical system results.
4UProfit is not responsible for performance differences caused by:
- expired access;
- inactive membership;
- manual renewal delays;
- disconnection;
- insufficient account eligibility; or
- periods during which the account did not receive operations.
21. ELIGIBLE RESULT
For purposes of the membership-charge policy, “Eligible Result” means the realized result attributed to the applicable billing period after relevant execution costs reflected in the applicable account or performance record, but before the 4UProfit membership charge.
Depending on the applicable environment, execution costs may include:
- broker commissions;
- exchange fees;
- regulatory fees;
- spreads;
- slippage;
- overnight financing; and
- other broker or market costs.
Unless expressly stated otherwise:
- deposits and withdrawals are not trading results;
- unrealized open-position profit or loss is not treated as a completed eligible result;
- membership charges are not included when initially determining the Eligible Result; and
- the calculation may differ from gross system-performance figures.
4UProfit may rely on account, broker, execution, and internal performance records reasonably available for the billing calculation.
22. MEMBERSHIP CHARGE POLICY
The membership structure has two separate components for each applicable thirty-day billing period.
A. Technology Membership
Each membership level has an applicable monthly Technology Membership. The Technology Membership provides access to the 4UProfit infrastructure, connectivity, monitoring and support during the membership cycle.
B. Performance Fee
The Performance Fee applies only to new eligible profits generated above the applicable High-Water Mark. The Performance Fee rate depends on the client's membership level.
C. Negative Period
If the Eligible Result for the applicable period is negative:
- no Performance Fee applies;
- 4UProfit covers the applicable Technology Membership for that period, resulting in no Technology Membership charge to the client for that period; and
- trading losses are not reimbursed.
D. Recovery After A Loss
Following a negative period, the previous High-Water Mark remains in place.
Subsequent gains must first recover the previous High-Water Mark before a new Performance Fee may apply.
Performance Fee applies only to new eligible profits generated above the prior High-Water Mark.
This billing mechanism is not:
- a guarantee of profit;
- a guarantee of capital;
- an insurance policy;
- a reimbursement of trading losses; or
- a promise that future results will recover prior losses.
23. PAYMENT AUTHORIZATION
By activating automatic renewal, you authorize 4UProfit and its payment processor to charge the applicable membership amount according to these Terms and the checkout disclosures.
You are responsible for maintaining a valid payment method.
If a payment fails, 4UProfit may:
- retry the payment;
- notify you;
- suspend access;
- prevent new strategy activity from being transmitted; or
- require manual reactivation.
4UProfit does not store full payment-card information when payments are processed by an independent payment provider.
24. MONTHLY WITHDRAWAL MODEL
4UProfit recommends periodically withdrawing available positive results rather than relying on compounding.
The operating model uses the selected reference capital for comparison and strategy configuration.
Leaving funds above the reference capital in the account does not automatically increase strategy sizing or operating capacity.
Clients seeking greater operating capacity may need to qualify for and activate the next applicable membership level.
The client remains free to retain, withdraw, or add funds, subject to broker requirements and account eligibility.
25. DEMO ACCESS
4UProfit may provide free and unlimited demo access for NinjaTrader Futures and Forex environments.
Demo accounts use simulated funds and may not reproduce live-market conditions.
Demo results may differ materially from live results because of:
- simulated fills;
- latency;
- liquidity;
- spreads;
- commissions;
- slippage;
- margin;
- market impact;
- broker behavior; and
- platform configuration.
Demo access does not guarantee future availability of a particular platform, instrument, feature, or data source.
4UProfit may update or discontinue a demo environment if required by technical, broker, platform, or operational changes.
26. HISTORICAL AND PERFORMANCE INFORMATION
Historical results are provided for informational and analytical purposes only.
Historical results:
- do not guarantee future results;
- may represent gross system activity;
- may differ from client-level results;
- may exclude certain costs unless expressly stated;
- may not reflect an individual account’s execution; and
- should not be interpreted as a promise or projection.
Where displayed, synthetic or demonstration data will be identified as such and does not represent actual 4UProfit performance.
Each performance view should identify whether it presents:
- gross system results;
- execution-adjusted results;
- illustrative client results;
- synthetic data; or
- another defined metric.
27. EXECUTION VARIANCE
A client account may perform differently from the source strategy because of:
- latency;
- slippage;
- spreads;
- broker commissions;
- exchange fees;
- account balance;
- available margin;
- contract sizing;
- connection timing;
- rejected orders;
- broker pricing;
- platform configuration;
- interrupted access;
- membership status; or
- manual intervention.
No connected account is guaranteed to produce an identical result to the source strategy or another account.
28. PAUSE AND DISCONNECTION
Clients may pause or disconnect future execution through available account controls or support procedures.
When a pause or disconnection becomes effective:
- new strategy activity will no longer be transmitted;
- previously transmitted orders may remain active;
- open positions are not automatically closed; and
- the client remains responsible for reviewing the brokerage account.
Pausing or disconnecting is not the same as liquidating an account.
Clients should review and manage open positions directly through their broker when necessary.
29. CANCELLATION
A client may cancel a membership through the available account settings or by contacting support at support@4uprofit.com.
Cancellation affects future membership renewal and future service access.
Cancellation does not:
- automatically close open positions;
- reverse completed trades;
- eliminate broker obligations;
- guarantee a favorable exit;
- cancel charges already validly incurred; or
- cause 4UProfit to control or block client funds.
The former practice of reserving up to ten business days to seek a favorable exit does not apply under these Terms.
4UProfit does not have unilateral authority to retain control of a client account after cancellation.
30. OPEN POSITIONS AT CANCELLATION
If a position remains open when the client pauses, disconnects, or cancels:
- the position remains in the client-owned brokerage account;
- it remains subject to market movement;
- broker margin requirements continue to apply;
- the client may manage or close it through the broker; and
- 4UProfit cannot guarantee its outcome.
4UProfit may provide general technical or operational support but does not guarantee a favorable exit or assume custody of the position.
31. CLIENT RESPONSIBILITIES
The client is responsible for:
- monitoring the brokerage account;
- maintaining sufficient margin;
- reviewing open positions;
- maintaining accurate account information;
- protecting credentials;
- maintaining compatible devices and connectivity where required;
- complying with broker agreements;
- understanding applicable risks;
- determining tax obligations;
- reviewing account statements;
- ensuring lawful use; and
- using only capital the client can afford to place at risk.
Clients must not rely solely on alerts, dashboards, or 4UProfit interfaces as substitutes for broker records.
32. PROHIBITED USES
You may not:
- use the Service unlawfully;
- interfere with its operation;
- bypass access controls;
- attempt unauthorized access;
- reverse engineer protected software;
- copy proprietary strategy logic;
- redistribute credentials;
- resell access without authorization;
- manipulate account or performance data;
- introduce malicious software;
- impersonate another person;
- use the Service for fraud or market manipulation; or
- violate broker, exchange, or platform rules.
33. INTELLECTUAL PROPERTY
The Service, including its software, strategy implementation, interfaces, branding, reports, documentation, design, content, databases, algorithms, workflows, and proprietary technology, is owned by or licensed to 4UProfit Business LLC and is protected by applicable intellectual-property laws.
Subject to these Terms, 4UProfit grants the client a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
No ownership interest is transferred.
34. SERVICE AVAILABILITY
4UProfit does not guarantee uninterrupted or error-free availability.
Service interruptions may result from maintenance, updates, cybersecurity events, internet failure, broker outage, exchange interruption, third-party platform failure, infrastructure failure, regulatory restrictions, force majeure, or other circumstances outside reasonable control.
4UProfit may temporarily suspend activity where reasonably necessary to protect users, systems, data, strategy integrity, or legal compliance.
35. SERVICE MODIFICATIONS
4UProfit may modify features, supported instruments, strategy parameters, platform compatibility, broker compatibility, reporting, risk settings, membership offerings, or technical requirements.
Where reasonably practical, material changes affecting active clients will be communicated in advance.
Emergency changes may be implemented without prior notice where necessary for security, broker compatibility, platform continuity, legal compliance, or risk management.
36. SUSPENSION AND TERMINATION BY 4UPROFIT
4UProfit may suspend or terminate access for breach of these Terms, nonpayment, fraud, unlawful activity, abuse, security risk, unauthorized account use, manipulated information, ineligibility, broker incompatibility, technical incompatibility, regulatory requirement, or conduct that threatens the Service or other users.
Where appropriate, 4UProfit may provide notice and an opportunity to correct the issue.
Immediate suspension may occur where necessary for security, fraud prevention, legal compliance, or operational protection.
37. TRADING RISK
Trading Futures, Forex, and CFDs involves substantial risk.
Clients may lose part or all of the capital in their brokerage accounts.
Leverage may increase both gains and losses.
Market conditions can change rapidly, and losses may occur despite predefined risk parameters, monitoring, stop orders, or automated controls.
No technology, strategy, broker, or risk framework can eliminate trading risk.
Clients should use only capital they can afford to place at risk.
38. NO GUARANTEE
4UProfit does not guarantee profits, minimum returns, recovery of losses, account preservation, continuous execution, identical replication, broker performance, uninterrupted service, execution at a specific price, maximum drawdown, withdrawal timing, or future strategy availability.
Past performance is not a guarantee of future performance.
39. NO INDIVIDUALIZED PROFESSIONAL ADVICE
Information provided through the Service is general and technology-related.
Nothing in the Service constitutes individualized legal advice, tax advice, accounting advice, personalized financial advice, an individual investment recommendation, or a guarantee that a strategy is suitable for a particular person.
Clients should consult qualified professionals where appropriate.
40. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, the Service is provided “as is” and “as available.”
4UProfit disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, and financial performance.
Some jurisdictions may not permit certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent legally permitted.
41. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, 4UProfit Business LLC, its officers, employees, contractors, affiliates, providers, and licensors will not be liable for direct, indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of or inability to use the Service.
This includes loss of capital, loss of profits, loss of investment opportunities, business interruption, loss of data, technology failures, execution errors, broker interruptions, third-party errors, or any other loss arising from use of the Service.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
42. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless 4UProfit Business LLC, its officers, employees, contractors, and collaborators from claims, demands, proceedings, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, misuse of the Service, violation of applicable law, infringement of third-party rights, or activity conducted through your account.
43. PERSONAL DATA PROTECTION
Personal data is processed according to the current Privacy Policy.
By using the Service, you acknowledge that certain information may be processed for account administration, authentication, payment processing, technical support, fraud prevention, security, Service improvement, legal compliance, and normal platform operation.
Use of the Service involves processing personal data according to that policy.
44. ELECTRONIC COMMUNICATIONS
You consent to receive electronic communications concerning your account, membership, renewals, payments, technical issues, security, Service changes, legal obligations, and other information needed to provide the Service.
Communications may be provided through email, in-platform notifications, the client dashboard, or another reasonably appropriate electronic method.
45. FORCE MAJEURE
4UProfit is not responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, wars, civil unrest, terrorism, pandemics, infrastructure failure, power interruption, cyberattacks, widespread internet outages, exchange or market interruptions, government action, regulatory changes, or similar events.
46. ASSIGNMENT
You may not assign or transfer rights or obligations under these Terms without 4UProfit’s prior written consent.
4UProfit may assign these Terms as part of a corporate reorganization, merger, acquisition, asset sale, or another corporate transaction permitted by applicable law.
47. WAIVER
A failure or delay by 4UProfit in exercising a right under these Terms does not waive that right.
Any waiver must be expressly made in writing.
48. SEVERABILITY
If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that determination will not affect the validity of the remaining provisions.
The affected provision will be interpreted or replaced only to the extent necessary to preserve, as far as possible, the parties’ original intent.
49. ENTIRE AGREEMENT
These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and 4UProfit Business LLC concerning the Service.
They replace prior communications, negotiations, proposals, or agreements concerning the same subject.
50. GOVERNING LAW
These Terms are governed by and interpreted under the laws of the State of Florida, United States of America, subject to any mandatory consumer-protection provisions that apply under law.
51. JURISDICTION
Unless applicable law requires otherwise, disputes arising from these Terms or use of the Service will be submitted to the exclusive jurisdiction of the competent state or federal courts located in the State of Florida, including, where applicable, courts with jurisdiction in Orange County, Florida.
Nothing above prevents 4UProfit from bringing an action in another jurisdiction where reasonably necessary to protect its rights or enforce these Terms.
52. LANGUAGE
These Terms may be made available in multiple languages to facilitate understanding.
If there is a discrepancy among language versions, the English version will control unless applicable law expressly provides otherwise.

54. EFFECTIVE DATE
These Terms take effect on the date stated at the beginning of the document.
