Trading Risk and Technology Disclaimer

This Disclaimer should be read together with the current Terms of Service, Risk Disclosure, Performance Disclosure, Membership and Billing Policy, Privacy Policy, and any additional disclosures presented during registration, account connection, membership activation, or checkout.
By accessing or using the 4UProfit platform, you acknowledge the risks and limitations described below.
1. PURPOSE AND SCOPE
This Disclaimer explains the principal trading, technology, execution, performance, and third-party risks associated with the use of 4UProfit.
It is intended to provide a clear summary of important limitations and should not be interpreted as a complete description of every possible risk.
The full contractual relationship between the client and 4UProfit is governed by the Terms of Service and any policies incorporated into those Terms.
2. NATURE OF 4UPROFIT
4UProfit is a financial technology platform that connects compatible client-owned brokerage accounts to automated execution and trade-replication technology.
The platform may provide:
- automated transmission of approved strategy activity;
- execution through compatible account connections;
- operational monitoring;
- predefined risk controls;
- performance reporting;
- account-connection tools;
- demo access; and
- technical and operational support.
4UProfit is not:
- a broker;
- a bank;
- an exchange;
- a custodian;
- an investment fund;
- a pooled investment vehicle; or
- a provider of individualized legal, tax, or accounting advice.
The Service provides technology and operating infrastructure. It does not guarantee financial performance.
3. NO CUSTODY OR CONTROL OF CLIENT FUNDS
4UProfit does not receive client deposits and does not custody client capital.
The client opens, owns, and controls the brokerage account.
The selected broker:
- holds the client's funds;
- processes deposits;
- processes withdrawals;
- determines margin requirements;
- executes orders;
- maintains official account records; and
- applies its own terms and procedures.
4UProfit does not:
- hold client funds;
- approve withdrawals;
- block withdrawals;
- transfer client capital to itself;
- determine broker processing times; or
- guarantee broker solvency.
Statements that a client may withdraw funds or maintain control of capital refer to the client's ownership and control of the brokerage relationship. They do not guarantee the immediate availability of every dollar while positions are open, margin is being used, settlements are pending, or broker restrictions apply.
4. SUBSTANTIAL RISK OF LOSS
Trading Futures, Forex, and CFDs involves substantial risk.
Clients may lose part or all of the capital maintained in their brokerage accounts.
The use of leverage can increase both gains and losses. Market conditions may change rapidly, and losses may occur despite:
- automated execution;
- predefined risk parameters;
- monitoring;
- stop orders;
- operational supervision; or
- other risk controls.
No technology, strategy, broker, or risk-management framework can eliminate trading risk.
Clients should use only capital they can afford to place at risk.
5. FUTURES, FOREX, AND CFD ENVIRONMENTS
The primary 4UProfit operating environment is Futures trading through compatible NinjaTrader accounts.
Forex and CFD execution may be available as a secondary alternative through supported brokers, subject to:
- jurisdiction;
- broker eligibility;
- account type;
- regulatory restrictions;
- instrument availability; and
- technical compatibility.
Futures, Forex, and CFDs have different market structures, trading hours, costs, leverage characteristics, margin requirements, and execution risks.
Availability through a broker does not mean that a particular product is legal, suitable, or available in every jurisdiction.
The client is responsible for determining whether the relevant broker, account, and financial instruments are permitted where the client resides.
6. INTRADAY OPERATIONS AND OPEN-POSITION RISK
The Futures strategy is designed to operate on an intraday basis using Eastern Time.
Futures positions are intended to be closed during the applicable trading session, generally no later than 5:00 p.m. ET.
4UProfit does not intentionally maintain Futures positions overnight.
However, extraordinary circumstances may affect the expected closing process, including:
- broker outages;
- platform failures;
- exchange interruptions;
- market halts;
- rejected orders;
- connectivity failures;
- extreme price movements; or
- other events beyond 4UProfit's reasonable control.
Forex and CFD operations are also generally managed intraday. However, market conditions, liquidity, broker execution, connection interruptions, or strategy requirements may occasionally cause a Forex or CFD position to remain open beyond the same trading day.
Open positions remain subject to market movements, margin requirements, broker rules, and potential loss.
7. AUTOMATED EXECUTION AND TECHNOLOGY RISK
The 4UProfit operating model combines automated execution with supervised strategy operation.
Automation may transmit and execute approved strategy activity without the client manually approving each individual order.
Automated execution is subject to technology and operational risks, including:
- internet failure;
- latency;
- delayed data;
- software errors;
- server interruption;
- connection loss;
- platform incompatibility;
- broker outage;
- rejected or duplicated orders;
- incomplete order transmission;
- exchange interruption;
- cybersecurity incidents; and
- third-party system failures.
Automation does not guarantee uninterrupted execution, exact order timing, a specific price, or identical results among connected accounts.
The strategy may remain inactive when market or operational conditions do not meet its criteria.
4UProfit does not guarantee that the strategy will trade every day or during every membership period.
8. PLANNED RISK PARAMETERS
The strategy is designed to use a planned risk that generally ranges between approximately 1% and 2% of the applicable reference capital for an individual operation.
The applicable risk level may depend on:
- strategy configuration;
- instrument;
- reference capital;
- position size;
- market conditions;
- available margin; and
- current operating parameters.
This planned range:
- applies to the operating parameters assigned to an individual operation;
- is not a guarantee of the final realized loss;
- is not a maximum drawdown guarantee;
- does not prevent cumulative losses from multiple operations or periods; and
- may be exceeded in extraordinary circumstances outside reasonable control.
Actual results may differ because of slippage, price gaps, reduced liquidity, rejected orders, market halts, broker execution, platform failure, exchange interruption, latency, margin liquidation, or other market and operational events.
9. REFERENCE CAPITAL
Each membership level is associated with a recommended reference-capital range.
Reference capital may be used to establish:
- operating level;
- position sizing;
- planned risk;
- monetary exposure;
- margin expectations;
- account eligibility; and
- applicable membership terms, including Technology Membership and Performance Fee terms.
Reference capital is not:
- a protected balance;
- an insured amount;
- a minimum guaranteed account value;
- a promise of preservation; or
- a performance guarantee.
Maintaining funds above one reference-capital level but below the requirements of the next level may not increase strategy sizing or operating capacity.
10. EXECUTION AND ACCOUNT VARIANCE
A connected account may perform differently from:
- the source strategy;
- published system results;
- historical results;
- another client account; or
- an illustrative scenario.
Differences may result from:
- latency;
- slippage;
- spreads;
- broker commissions;
- exchange and regulatory fees;
- broker pricing;
- available margin;
- account balance;
- contract or position sizing;
- connection timing;
- rejected orders;
- platform configuration;
- disconnections;
- inactive membership periods;
- missed operations;
- manual intervention; or
- other execution conditions.
Trade replication does not mean that every connected account will produce an identical result.
Operations missed while an account is disconnected, inactive, ineligible, or without an active membership will not ordinarily be recreated after access is restored.
11. HISTORICAL RESULTS
Historical results are provided for informational and analytical purposes only.
Past performance does not guarantee future performance.
Historical system results may differ from individual client results because of execution costs, account conditions, broker differences, timing, and other factors.
A historical percentage should not be interpreted as:
- an expected future return;
- a guaranteed result;
- a projection;
- a minimum result;
- a promise of profit; or
- an assurance that losses will be recovered.
Every performance presentation should identify the type of result being displayed and any material assumptions used.
12. GROSS, NET, AND ILLUSTRATIVE RESULTS
Performance information may include different result types, including:
- gross system results;
- execution-adjusted results;
- illustrative client results;
- results before applicable Technology Membership and Performance Fee treatment;
- results after applicable Technology Membership and Performance Fee treatment;
- demo results;
- simulated results; or
- synthetic data.
Gross system results may not include:
- broker commissions;
- exchange fees;
- regulatory fees;
- spreads;
- slippage;
- overnight financing;
- taxes;
- Technology Membership charges;
- Performance Fee charges; or
- other account-specific costs.
Illustrative client results are examples based on stated assumptions and do not represent a guarantee that a particular client would have obtained the same outcome.
Users must review the label, methodology, assumptions, and cost treatment associated with each performance view.
13. HYPOTHETICAL, SIMULATED, AND SYNTHETIC DATA
Hypothetical, simulated, synthetic, retrospective, or demo results do not represent actual live trading results unless expressly identified otherwise.
Such results may be prepared to:
- demonstrate page functionality;
- illustrate the membership model;
- explain reference-capital scenarios;
- test reporting components; or
- show how historical information may be analyzed.
These results may not fully reflect:
- real liquidity;
- market impact;
- emotional or operational decision-making;
- actual fills;
- broker behavior;
- live spreads;
- slippage;
- rejected orders;
- latency;
- margin events; or
- unexpected market conditions.
Synthetic or simulated information must not be interpreted as actual 4UProfit performance or actual client performance.
14. DEMO ACCOUNT LIMITATIONS
4UProfit may provide free and unlimited demo access for NinjaTrader Futures and Forex environments.
Demo accounts use simulated capital and may not reproduce live-market conditions.
Demo performance may differ materially from live-account performance because of:
- simulated fills;
- lack of market impact;
- different liquidity;
- spreads;
- commissions;
- latency;
- slippage;
- margin treatment;
- broker configuration; and
- platform behavior.
Demo results do not guarantee that the same strategy, account, or user will achieve similar results in a live environment.
15. MEMBERSHIP, PERFORMANCE FEES, AND HIGH-WATER MARK
The membership structure includes two separate components:
(a) a monthly Technology Membership; and (b) a Performance Fee.
The Technology Membership provides access to the 4UProfit infrastructure, connectivity, monitoring, and support during the membership cycle.
The Performance Fee applies only to new eligible profits generated above the applicable High-Water Mark. The Performance Fee rate depends on the client's membership level.
If the account records a negative period:
- no Performance Fee applies;
- 4UProfit covers the applicable Technology Membership for that period, resulting in no Technology Membership charge to the client for that period; and
- trading losses are not reimbursed.
Following a negative period, the previous High-Water Mark remains in effect. Subsequent gains must first recover the previous High-Water Mark before a new Performance Fee may apply. Performance Fee applies only to new eligible profits generated above the prior High-Water Mark.
This pricing and billing structure is not:
- a performance guarantee;
- a capital guarantee;
- an insurance policy;
- a reimbursement of trading losses; or
- a promise that future periods will recover prior losses.
The client may still experience trading losses even when no Performance Fee or Technology Membership charge applies.
16. PAUSE, DISCONNECTION, AND CANCELLATION
The client may pause or disconnect future execution through available controls or support procedures.
Before disconnecting or allowing a membership to expire, the client should verify whether any position remains open.
When a pause or disconnection becomes effective:
- future strategy activity is no longer transmitted;
- orders previously transmitted may remain active;
- open positions are not automatically closed;
- the account may not receive a future strategy instruction intended to close or manage an existing position; and
- the client remains responsible for reviewing and managing the brokerage account.
4UProfit is not responsible for the subsequent result of an open position that remains unmanaged because the client voluntarily paused, disconnected, cancelled, or allowed access to expire.
Futures positions are intended to close intraday, generally by 5:00 p.m. ET. Forex and CFD positions may occasionally remain open beyond the same trading day.
Cancelling a membership affects future renewal and access. It does not:
- automatically liquidate the brokerage account;
- reverse completed transactions;
- guarantee a favorable exit;
- eliminate obligations owed to the broker; or
- give 4UProfit custody or control of client funds.
17. THIRD-PARTY BROKERS AND PLATFORMS
Brokers, NinjaTrader, MetaTrader, exchanges, data providers, payment processors, and other external services are independent third parties.
Their services are governed by separate terms.
4UProfit does not control or guarantee:
- broker solvency;
- order execution;
- broker prices;
- spreads;
- commissions;
- exchange fees;
- margin requirements;
- liquidation procedures;
- platform availability;
- data accuracy;
- withdrawal timing;
- cybersecurity practices; or
- changes made by third-party providers.
A link to or reference to a third party does not create a partnership, agency, endorsement, fiduciary relationship, or guarantee.
18. BROKER INDEPENDENCE
4UProfit does not receive:
- referral commissions;
- CPA payments;
- broker revenue sharing;
- introducing-broker compensation;
- paid broker-ranking fees;
- sponsored-listing compensation; or
- financial incentives to recommend one broker over another.
Broker inclusion is based on factors such as regulatory standing, reputation, operating history, execution quality, technological compatibility, pricing transparency, withdrawal reliability, and jurisdictional availability.
The order in which brokers appear on the website does not constitute a paid ranking.
Any future material commercial or technological relationship with a broker will be disclosed where appropriate.
19. NO GUARANTEED RESULTS
4UProfit does not guarantee:
- profit;
- a minimum rate of return;
- a particular monthly result;
- account preservation;
- loss recovery;
- uninterrupted execution;
- identical replication;
- a maximum drawdown;
- execution at a particular price;
- permanent strategy availability;
- broker performance; or
- immediate withdrawal processing.
No statement, chart, report, example, testimonial, historical result, or marketing material should be interpreted as modifying this absence of guarantee.
20. NO INDIVIDUALIZED ADVICE
Information made available by 4UProfit is general and related to the operation of its technology and services.
Nothing provided through the website, dashboard, reports, support communications, or other materials constitutes individualized:
- legal advice;
- tax advice;
- accounting advice;
- personalized financial advice; or
- a guarantee that the Service is appropriate for a particular person.
The client remains responsible for evaluating personal financial circumstances, risk tolerance, objectives, legal obligations, and suitability.
Independent professional advice should be obtained where appropriate.
21. CLIENT RESPONSIBILITY
The client is responsible for:
- understanding trading risk;
- monitoring the brokerage account;
- reviewing open positions;
- maintaining sufficient margin;
- reviewing broker statements;
- protecting account credentials;
- maintaining compatible technology and connectivity where required;
- complying with broker agreements;
- determining tax obligations;
- evaluating whether the Service is appropriate; and
- using only capital the client can afford to place at risk.
4UProfit dashboards, reports, charts, alerts, and notifications do not replace the broker's official records.
22. INFORMATION ACCURACY
4UProfit seeks to present accurate and current information but does not guarantee that every page, report, chart, calculation, integration, market value, or third-party data point will always be complete, current, or error-free.
Information may be delayed, corrected, updated, or replaced.
Clients should verify material account information through the relevant broker and should not rely solely on 4UProfit interfaces when making account-management decisions.
23. LIMITATION AND RELATIONSHIP TO OTHER POLICIES
This Disclaimer summarizes key risks and limitations but does not replace the Terms of Service, Risk Disclosure, Performance Disclosure, Membership and Billing Policy, Privacy Policy, or other applicable agreements.
If this Disclaimer conflicts with the Terms of Service, the Terms of Service will control, subject to applicable law.
Nothing in this Disclaimer excludes responsibility that cannot legally be excluded.
The scope of any limitation of liability is governed by the current Terms of Service and applicable law.
24. CHANGES TO THIS DISCLAIMER
4UProfit may update this Disclaimer to reflect changes in:
- the Service;
- technology;
- strategy operation;
- supported markets;
- broker compatibility;
- performance reporting;
- applicable law; or
- risk disclosures.
The current version will display an updated date.
Continued use of the Service after an updated version becomes effective constitutes acknowledgment of the revised Disclaimer, except where additional consent is required by law.

- automated execution may fail or vary;
- account results may differ from source or system results;
- planned risk parameters do not guarantee a maximum realized loss;
- third-party brokers and platforms create additional risks;
- 4UProfit does not custody client capital;
- 4UProfit does not guarantee profits; and
- the client remains responsible for monitoring and managing the brokerage account.
